This is an absolutely fascinating and useful article for an interested observer who is not an expert on the court's procedures. It zeroes in on the key issues surrounding this decision, and also more broadly shows how the court operates. Thank you!

I agree with the two comment posters. Very well thought out and balanced analysis of the three-day SCOTUS extravaganza by Mr. Greely. I agree with the sentiment that CNN's Jeffry Toobin lost all credibility by going from a prediction of 8-1 that the SC would uphold the law before the oral arguments to a very emotional prediction of the law's demise based on hearing the oral arguments. Most legal scholars have warned that you cannot predict with precision anything from the direction of SC oral arguments. Perhaps Mr. Toobin is a shock jock much in the same league as someone like Rush Limbaugh. Or, at the very least, we have to question Mr. Toobin's intellectual integrity and balance. I agree with Mr. Greeley--why should we listen to someone like that? Mr. Greeley, on the other hand, has demonstrated a very good grasp of the facts and the process.

I, too have followed these posts and am so impressed with your analysis and thoughtfulness. Clearly you have found your niche and the blogosphere -- not to mention all of us -- is the better for it. Keep up the good work. Lisa

Hi, Hank,

This is a beautiful piece. We were steered to it by Leslie (our daughter, a Stanford Law grad--my guess is you know her). Indeed, this is THE most interesting comment on the argument that I have seen. Congratulations -- and thanks, too.
