I don&#039;t think you mentioned that if a medical team proceeds without consent (or against consent) they can be charged with battery. Competence is a legal term to be determined by a judge. It is often used interchangeably with capacity. Decision making capacity is
 something that a medical professional can determine. Even someone who is
incompetent legally may have capacity for some medical decisions. And vice versa, someone who is legally competent may not have capacity for decisions. Capacity must be determined for each decision. Someone can be capable of making some decisions and not others, even in the same hospital stay.
If someone is at risk for harming themselves or others, they can be held without consent. California&#039;s 5150 is called a Blue Sheet in Utah.
